Bankruptcy no. 98/2019 Court of Palermo

24/01/2022 Attention: the lease of the commercial space will expire on 31/10/2023.
Sale of the following assets forming part of the business complex of the bankrupt company located in Palermo (PA), in Viale Regione Siciliana n. 2034.

The company subject to a competitive tender is made up of:

- permits issued for the exercise of neighborhood retail trade for an area equal to 280 square meters of a permanent nature; certified reporting at the start of business activity - wholesale trade of non-food products; the authorization to manufacture and hold, for marketing purposes, materials intended for the equipment of the Armed Forces;
- the lease contract for the commercial space;
- the business unit lease agreement;
- company assets and equipment (furniture and furnishings, pc, sewing machines, forklifts, vans, etc.)

As reported in the appraisal, the company was established on 28/04/1986 in the form of a limited liability company.

The corporate purpose was, and still is, the sale and wholesale and retail trade activity both in national and foreign markets, and possibly the possible production, assembly and placement of anti- accidents and personal protection.

The registered office is rented in accordance with the lease contract stipulated on 1.11.2011 - and amended on 6.6.2013. The duration of the lease was agreed in 6 years, extendable for the next 6 years; therefore at the time of the bankruptcy the company had already made use of the extension of the lease contract whose natural expiry date will be 31.10.2023.

In 2017, on 5.06.2017, the bankrupt company entered into a company lease contract. In particular, the rent concerns the current company in Palermo, Viale Regione Siciliana S / E n.2020-2034; the lease also includes all public and private contracts for the supply of material and services, as well as all movable goods that furnish or accompany the company sold, tools, utensils; it does not include goods and raw materials, which have been the subject of a separate sale between the parties.

The five-year lease contract expiring on 04.06.2022 can be tacitly extended from year to year.
