Lot Description

Bankruptcy n. 194/2019 of the Court of Florence

Sale of a company of a company dedicated to the production of plastic sticks and related containers (molds) and paper sticks and related packaging, located in the Municipality of Pontassieve and consisting of:

- Movable assets instrumental to the exercise of the activity as per the inventory drawn up by the Surveyor Maionchi;
- Mercedes 316CDI truck, registered CD613PP, diesel fuel, 2685 cc., Registration year 2002, box / tarpaulin as per inventory;
- Real estate: industrial shed located in Pontassieve (FI), Via Colognolese n. 1 / A registered in the Urban Cadastre of the Municipality of Pontassieve on Sheet 93, particle 126, Sub 501, Category D / 1 cadastral income Euro 7,230.40.
- photovoltaic system that occupies about half of the total coverage area of ??the shed the surface of the plant (about 370 panels): this system currently not in operation, develops a power of about 90 KW and is made up of 9 inverter groups of 10 KW each .
- "Pressing Plastic" brand, brand no. 302013902188489 (FI2013C001178) filed on 09/09/2013, as per appraisal;
- Goodwill as per appraisal

Basic auction price: € 638,800.00 (six hundred thirty eight thousand eight hundred / 00)
Minimum offer € 507.850,00 (five hundred and seven thousand eight hundred and fifty / 00)

The business complex is currently leased until August 31, 2022 with the right of the curatorship to terminate the contract in advance in the event of the definitive award of the Company to a person other than the Tenant, at the simple request of the Legal Receiver to be made by means of a Pec communication. 

It should be noted that:

- the company is the subject of a company lease agreement signed on 1 August 2019, prior to the bankruptcy and still in progress, better described below;
- in force of the company lease contract, the tenant company has declared itself irrevocably willing to purchase the leased company, subject of this notice, at the price of € 115,000.00, including equipment, goodwill, trademark and capital goods;
- the Procedure intends to initiate a sales experiment, setting the price offered by the tenant company in the lease as the basic auction price for all the assets relating to the company;
- in the event of failure to submit further offers during the experiment and the validity of the company lease contract, the tenant company will not in any case be deemed to be the temporary contractor of the company referred to in Lot 2 - AUCTION No. 6515
- In the appraisal of the Surveyor Maionchi there are assets held under a financial leasing contract, not part of the company as the curator has decided not to take over
in the same.
- GOODS STOCKS are not included in the company and can be purchased with the consent of the tenant (the sale price therefore does not include the purchase of such stocks).
- The pre-emption right of the company currently tenant applies to this sale.
- The business complex is currently leased until 28/02/2023 with the right of the curatorship to terminate the contract in advance in the event of the definitive award of the company to a subject other than the tenant, at the simple request of the Curator to be made by communication Pec.

The sale of the company as a whole, or the purchase of one or more of the lots described above, will take place through a competitive auction on the portal www.industrialdiscount.it (in the case of an auction relating to lots nos. 1 and 2 or on the portal www .quimmo.it (in the case of an auction relating to lot no. 3) Bids may be presented, alternatively, for the "Freezing of assets" (lot no. 1), or for the "Compendium of movables" (lot no. 2), or they may be presented for the "Real Estate Compendium" (lot no. 3). The receipt of offers presented for the entire block of assets (Lot 1) will prevail over any offers presented for individual lots.
