Bankruptcy no. 24/2021 Court of Marsala


It was entrusted to Abilio S.p.A. the management of the operations for identifying the lessee with whom to conclude the lease contract of the business branch referred to below, in the factual and legal consistency in which it is currently located, and in particular the business branch having as its object the establishment activity seaside resort located in Campobello di Mazara, east coast in the Tre Fontane hamlet, with relative supply of food and drink, made up of some wooden shacks in precarious maintenance conditions, managed on a state-owned area by virtue of state-owned concession n.87/2018 of 26.07. 2018 rep. 5603, issued by the Territory and Environment Department of the Sicilian Region.

It is specified that:
- the Curator received an irrevocable purchase offer for the amount of €25,000.00 (called twenty-five thousand/00), plus legal charges and in addition to the commission on the sale due to Abilio S.p.A., as specified below;
- the Procedure intends to start a sales experiment, placing the irrevocable purchase offer received as the starting point for the auction, the methods of execution of which are governed by these Tender Regulations.
- duration of the contract of 12 months, compatibly with the liquidation requirements and in any case a duration not exceeding the presumed date of the liquidation pursuant to art. 104 bis c 4 l.f., with the Curator's right to withdraw at any time, having heard the CDC, upon payment of a just compensation which, in the event of disagreement between the parties, will be determined by the delegated judge pursuant to art. 79 bankruptcy law;
- There is an obligation for the tenant to pay, in addition to the rent, the annual state concession fee;
- The award that took place in the auction will be considered final only and exclusively following authorization and confirmation of the finality of the same by the Bodies of the Procedure.
