BANKRUPTCY N. 19/2018
Transfer of the business complex relating to the management of the tourist port of Borghetto Santo Spirito with no. assets under its belt. 204 berths measuring between 5 and 8 metres, n. 7 spaces intended to host commercial activities of various kinds, n. 60 parking spaces (including some lockable garages), n. 10 cellars. Inside the marina there is also an area intended for small shipbuilding and the refitting of pleasure craft.
The company, without prejudice to the existence of the concession title regarding the state-owned area in which it is located, is made up of:
- Moorings for boats from 5 to 8 m;
- Buildings intended for industry (piers, piers, docks, garages, cellars, shops);
- Construction site machinery and equipment;
- Office and electronic machines;
- Wooden buildings/mobile structures;
- n. 1 service vessel and one outboard motor;
- Furnishings (Expo kit);
- Communication and remote signaling system (nautical VHF system);
- n. 1 Ape TM Piaggio;
- n. 3 existing employment relationships;
- Contracts stipulated for carrying out company activity
Business complex, consisting of the occupation and use of a state-owned maritime area of ??23,670 m2 of which 5,340 m2 of land areas and 18,330 m2 of sea areas, for a total of 23,670 m2, for the purpose of maintaining the landing activity tourism and shipbuilding for boats up to 8 meters in length.
It should be noted that the business activity is carried out in a state-owned maritime complex including containers, various buildings, docks and yard areas and directly overlooking the body of water, in the proximal part of which a mooring catenary is installed.
The aforementioned state-owned assets are currently used under state concession no. 45/2005, document of 20 December 2023, reg. conc. 11/2023, repertoire register 1855/2023 which redetermined the duration of the concession in 62 years starting from 01 October 2005 (date of the original deed) and therefore expiring on 30 September 2067.
This concession was entrusted through the contract for the construction and management of the tourist port stipulated with the Municipality of Borghetto Santo Spirito on 8 March 2006, rep. 1427.
It is also specified that the credits and debts relating to the operation of the business branch, of any kind and nature, including tax and social security ones, accrued or originating in a period prior to the date of transfer of ownership, even if they emerged or manifested subsequently, who, therefore, will continue to be part of the bankruptcy procedure, according to the rules of the competition.
Base auction price: Euro 1,700,000.00
Minimum raise: Euro 50,000.00

Subjects who, alternatively, have submitted their offer using the methods referred to in point A (telematic offer) or point B (analogue offer) will be able to participate in the tender.
A. OFFER TELEMATICALLY
The electronic purchase offers must be received by the presenters of the offer no later than 12.30 pm on 22/01/2024 by sending them to the PEC address of the Ministry amministrazionepvp.dgsia@giustiziacert.it, using exclusively the form pre-compiled form available on the ministerial portal http://venditepubbliche.giustizia.it. The electronic offer is considered deposited when the complete delivery receipt is generated by the certified email manager of the Ministry of Justice.
The auction takes place on the website www.venditegiudiziarieitalia.it on 23/01/2024 from 3.00 pm onwards and lasts 1 minute unless further offers are submitted. Below is the link to the auction page:
B. OFFER WITH ANALOGUE MODE
The deadline for the submission of offers "in a sealed envelope" is set for 22/01/2024 no later than 12.30 pm to be delivered in a sealed envelope (and without any sign of recognition) by hand to the studio of the Curator located in Albenga (SV) in Viale Martiri della Libertà n. 68/3.
The bidder who has deposited the offer in a sealed envelope, on the day set for the sale, is required to present himself at the office of the Curator located in Albenga (SV) in Viale Martiri della Libertà n. 68/3, on 23/01/2024 at 3:00 pm.
