BANKRUPTCY PROCEEDINGS 143/2019
Assignment of the action – including all rights, powers and expectations related to it and arising from it – pending before the Court of Venice, Specialized Section for Business Matters, – R.G. 5208/2024, promoted by the Bankruptcy for abusive granting of credit towards some Credit institutions, with which compensation claims for €2,884,126.28 were enforced, equal to the sum of the total charges indicated in the writ of summons.
It is also specified that the successful tenderer must comply with the following conditions:
The Successful Tenderer will be required to recognize an earn out to the Bankruptcy if the proceeds of the Action, defined in court or in a settlement, exceed €250,000. The Successful Bidder shall pay the Earn Out when the relative sums are definitively collected (regardless of whether by virtue of an irrevocable judgment or a transaction with the counterparties or part of them), in an amount equal to 40% of the sums exceeding the aforementioned limit of € 250,000, with the Successful Bidder himself undertaking to make the relative payment within 48 hours of receiving the sums themselves.
He is required to pay the full balance of the price (minus the Deposit), the accessories and/or other taxes required by law, at the same time as the transfer of the Action, regardless of the subsequent outcome of the case.
He is required to provide, at his own expense and care, for the notifications, annotations, registrations and any other formalities that are necessary for the effectiveness and enforceability of the sale, also with reference to the takeover of the process pursuant to art. 111 c.p.c.
Auction starting price: €70,000.00
Minimum auction raise: €2,500.00
ASYNCHRONOUS TELEMATIC SALE PROCEDURE

Telematic offers must be received by the offer submitters no later than 12:00 on 05/03/2025 by sending them to the Ministry's PEC address offertapvp.dgsia@giustiziacert.it, using exclusively the pre-filled form available on the ministerial portal http://venditepubbliche.giustizia.it. The electronic offer is considered deposited when the receipt complete with delivery is generated by the certified email manager of the Ministry of Justice
The asynchronous auction takes place on the website www.venditegiudiziarieitalia.it on 06/03/2025 from 15:00 and following hours and will last two hours, unless further bids are submitted.

The Data Room is designed to allow parties interested in purchasing the compendium for sale access to information relating to the property.
