BANKRUPTCY PROCEEDINGS 143/2019
Transfer of the liability action promoted by the Bankruptcy Trusteeship no. 143/2019, still pending, against some former directors, as well as other parties deemed responsible for the bankruptcy.
With reference to the Single Lot above, it is specified that:
- The proceeding has been opened: Civil Case: no. 3417/2021 R.G. at the Court of Venice, Specialized Section in Business Matters.
It is also specified that the successful tenderer must comply with the following conditions:
A) The payment of the price balance of €700,000.00 or any higher amount determined as a result of the auction, must take place at the latest at the same time as the act of transfer of the liability action, regardless of the subsequent outcome of the case.
B) The successful tenderer must recognize an earn out to the Bankruptcy if the proceeds of the action, defined in court or in a settlement, exceed 1.3 million euros.
C) The payment of such earn out must occur when the relative sums are definitively collected (regardless of whether by virtue of an irrevocable judgment or a settlement with the counterparties or part of them), in an amount equal to 40% of the sums exceeding the aforementioned limit of 1.3 million euros, with the successful tenderer committing to make the relative payment within 48 hours of receiving the sums themselves.
Auction starting price: €700,000.00
Minimum auction increase: €15,000.00
ASYNCHRONOUS TELEMATIC SALE PROCEDURE

Telematic offers must be received by the offer submitters no later than 12:30 on 14/10/2024 by sending them to the Ministry's PEC address offertapvp.dgsia@giustiziacert.it, using exclusively the pre-filled form available on the ministerial portal http://venditepubbliche.giustizia.it. The electronic offer is considered deposited when the receipt complete with delivery is generated by the certified email manager of the Ministry of Justice
The asynchronous auction takes place on the website www.venditegiudiziarieitalia.it on 15/10/2024 from 10:00 and following hours and will last two hours, unless further bids are submitted.

The Data Room is designed to allow parties interested in purchasing the compendium for sale access to information relating to the property.
